Terms & Conditions Of The CWW Website Bulletin Board/Discussion Forum

English law treats Internet Service Providers (ISPs) and owners of bulletin boards and discussion forums as publishers and therefore a potential party to a libel action. Your committee has decided that it is essential for the Circle to protect itself against any potential libel and has drawn up the following set of rules governing the use of the bulletin board/discussion forum. These rules are similar to those that anyone wishing to join a bulletin board/discussion forum has to accept. The committee, however, believes firmly that self-restraint is the best option and hopes that it will never be necessary to debar any member from the bulletin board/discussion forum.

Rules, Policies, and Disclaimers

All members of the Circle of Wine Writers (CWW) will be deemed to have agreed to obey the following rules. Anyone breaking the rules will be issued with a written warning by email from the webmaster, or barred from using the bulletin board/discussion forum should the committee consider the offence warrants such action. After a written warning has been issued, any further contraventions will result in the member being barred from the bulletin board/discussion forum for a period of time to be determined by the committee. Any member so barred will have the right of appeal.

While the CWW does not and cannot control the information/materials posted on the bulletin board/discussion forum (the "messages"), it reserves the right (which it may exercise at its sole discretion without notice) to delete, move or edit the messages and to terminate members’ access to and use of the bulletin board/discussion forum, and members waive any moral rights that they may have in regard to the messages.

Members are solely responsible for the content of their messages. They must comply with any rules posted by CWW on a bulletin board/discussion forum. They may not:

* post, link to or otherwise publish any messages that are unlawful, threatening, abusive, defamatory, libellous, indecent, infringe copyright or other rights of third parties (including other members) or which contain any other form of illegal content;

* post, link to or otherwise publish any messages containing any form of advertising or promotion for goods and services or any chain messages or "spam";

* post, link to or otherwise publish any messages which contain confidential information of another party;

* post or otherwise publish any messages that contain a virus or other harmful component;

* disguise the origin of any messages;

* post or transmit any messages that contain software viruses, files or code designed to interrupt, destroy or limit the functionality of the forum or any computer software or equipment;

* collect or store other members’ personal data;

* restrict or inhibit any other member from using the bulletin board/discussion forum.

By submitting messages to the bulletin board/discussion forum you agree to indemnify and hold harmless the CWW, its committee, officers, webmaster and members (other than yourself), from all claims, costs and expenses (including legal expenses) arising out of any messages posted or published by you that are in breach of the terms and conditions of this notice.

The bulletin board/discussion forum contains messages submitted by members over whom the CWW has no control. The CWW cannot guarantee the accuracy, integrity or quality of any messages. Some members may breach these terms and post messages that are misleading, untrue or offensive. All members must bear all risks associated with their use of the bulletin board/discussion forum, including the risk of defamation, and by submitting messages to the bulletin board/discussion forum, all members agree that they will not make any claim against the CWW, its committee, officers, webmasters and other members arising out of any messages posted or published thereon, save for the author of any such message, whether such claim is in respect of defamation or otherwise. Members should not rely on messages in making (or refraining from making) any specific investment or other decisions.

It is not possible for the CWW to monitor whether any messages infringe the copyright of a third party or other third party rights.
